TERMS AND CONDITIONS 

Please carefully review the terms and conditions below before submitting your application. By participating, you agree to comply with the following terms and conditions:

DEFINITIONS

“Event” refers to the ‘RESURRACK’ marketplace, a curated space designed to showcase vintage and modern vendors, facilitating a unique shopping experience for the public. 

“Vendor/Vendors” refers to the individual(s) or entity(ies) that submit an application and subsequently rent booth space at the ‘RESURRACK’ marketplace.

“Organiser” refers to ELEVENTS AGENCY PTE LTD, the entity responsible for the organization and management of the Event.

“Landlord” refers to CAPITALAND RETAIL MANAGEMENT PTE LTD, the entity that owns and manages the premises where the Event is held.

  1. Booth Fees

Booth fees are strictly non-refundable, except in the event of cancellation by the Organiser.

All fees must be paid within 5 days of the confirmation message being sent. Failure to complete payment by the specified deadline may result in forfeiture of your booth reservation.

Booth fees cover the cost of the designated booth space, access to power, and any standard inclusions as listed in the booth category description.

Booth fees are strictly non-negotiable, unless otherwise determined by the Organiser in exceptional circumstances. The booth will be forfeited should an unregistered seller or unauthorised individual attempt to occupy the space during the event.

  1. Booth Curation

Vendor curation is subject to the Organizer’s approval, and signing up for the application does not guarantee participation in the event.

The Organizer reserves the right to reject any goods deemed inappropriate or unsuitable for the event, at any time of the event.

  1. Booth Ownership

Booth ownership is non-transferable. Vendors may not sell, rent, or sublease their booth space to other vendors without prior written consent from the Organizer.

All goods and services sold within the booth must be provided by the registered vendor and in accordance with the event guidelines.

The registered vendor is solely responsible for the management of the booth and must ensure compliance with all event rules and regulations.

The Organiser reserves the right to reassign the booth at their discretion should the vendor fail to comply with the event’s policies.

  1. Booth Operations

Vendors are required to set up and be fully operational 15 minutes before the event start time (3:00 PM), as specified by the Organiser.

Booths must remain open and operational for the entire duration of the event. Early teardown or closure is not permitted unless explicitly authorised by the Organiser.

Vendors are responsible for maintaining the cleanliness and organisation of their booth throughout the event. All waste must be properly disposed of in designated areas.

Vendors must adhere to safety guidelines provided by the Organiser, including compliance with fire safety regulations, electrical usage, and crowd management.

All promotional activities, including signage and displays, must remain within the confines of the assigned booth space and must not obstruct walkways or neighbouring booths.

Vendors are prohibited from playing loud music or using amplified sound unless approved by the Organiser, to ensure a comfortable atmosphere for all participants and to maintain only one sound source throughout the event.

The Organiser reserves the right to inspect booths at any time during the event to ensure compliance with event policies and safety standards.

Any damage caused to the booth space, event property, or venue will be the responsibility of the vendor, and any associated repair costs will be charged accordingly.

Vendors are required to cease all sales by 9:00 PM each operating day. Additionally, all merchandise and personal belongings must be packed and removed by the event teardown deadline of 10:00 PM on Sunday. Exceptions apply only for vendors who will be returning to vend the following week.

  1. Booth Allocation

Booth allocation will be conducted in a manner that is random and impartial, ensuring that all vendors have an equal opportunity to secure a booth space.

The Organiser will curate the selection based on the best of their abilities, taking into consideration various factors such as product diversity, vendor experience, and overall event goals.

While all efforts will be made to accommodate vendor preferences, the final decision regarding booth placement lies solely with the Organiser.

Vendors will be notified of their assigned booth location in advance of the event, and any requests for changes after assignments are made may not be accommodated.

The Organiser reserves the right to make adjustments to booth assignments as necessary to maintain the event's overall layout and flow.

All vendors are expected to comply with the assigned booth allocation to ensure a cohesive and successful event experience.

  1. Booth Appearance and Maintenance

Vendors are responsible for the overall appearance and maintenance of their booths throughout the event. Booths must be clean, organised, and visually appealing to enhance the overall atmosphere of the event.

All displays, signage, and promotional materials should be professional in appearance and relevant to the products or services being offered.

Vendors are required to adhere to any specific guidelines provided by the Organiser regarding booth design, setup, and maintenance. This includes restrictions on height, lighting, and signage to ensure uniformity and safety within the event space.

Vendors are strictly prohibited from displaying or selling any inappropriate items that may be deemed offensive or unsuitable for the event.

The Organizer reserves the right to conduct inspections of booths at any time to ensure compliance with appearance and maintenance standards. Any vendor found in violation of these standards may be given a warning or required to make immediate improvements.

  1. Product Restrictions

The list of restricted products and services includes, but is not limited to, the following:

  1. Illegal substances or drugs
  2. Counterfeit or pirated goods
  3. Weapons, firearms, or explosives
  4. Hazardous materials or items that pose a safety risk
  5. Offensive, obscene, or pornographic materials
  6. Products that promote hate speech, discrimination, or violence
  7. Tobacco, alcohol, or vaping products without proper licence
  8. Stolen goods or items obtained through illegal means
  9. Services or goods promoting illegal activities or pyramid schemes
  10. Spoiled or damaged items, unless they are vintage art or collectibles and are clearly labelled as such to reflect their condition.

The Organizer reserves the right to inspect and approve all goods being sold during the event. Any items found to be in violation of these restrictions must be immediately removed from the booth.

Violations of the product restrictions will result in immediate removal from the event, and vendors may be blacklisted from future events. 

  1. Security and Responsibility

The Organiser is not responsible for any loss, theft, or damage to vendor property, assets, or products during the event. Vendors are encouraged to take necessary precautions to secure their belongings and merchandise at all times.

Overnight storage of goods is strictly at the vendor's own risk, as the event does not provide security personnel for overnight protection. The event organisers are not liable for any loss, theft, or damage to items left overnight

The Organiser will not be held liable for any incidents, including but not limited to theft, damage caused by weather, accidents, or other unforeseen circumstances affecting vendor property, assets, or products.

Vendors are strongly encouraged to secure appropriate insurance coverage for their goods, equipment, and liabilities, as the Organiser does not provide any form of insurance or compensation for losses, damages, or liabilities incurred by the vendor.

  1. Conduct of Behaviour

Vendors must maintain a professional and respectful attitude toward the event staff, fellow vendors, and attendees.

Any misconduct, including disruptive behaviour, will lead to removal from the market immediately.

  1. Marketing and Promotion

By participating in the event, vendors hereby grant the Organizer the right to feature their business, products, and related materials in the market's promotional campaigns, including but not limited to advertisements, social media, and digital marketing. 

  1. Booth Refund Policies

Booth fees are strictly non-refundable, except under the following circumstances:

  • If the Organiser cancels the market prior to its commencement, vendors will be eligible for a full refund of booth fees.
  • If the event cannot proceed due to circumstances beyond the Organizer’s control, such as natural disasters, severe weather conditions, acts of terrorism, or governmental regulations, vendors will be entitled to a full refund of their booth fees.
  • If the Organiser relocates the event to a venue significantly different from the original location, vendors may request a refund.
  • If the event location is deemed unsafe due to health or safety concerns (e.g., pandemic outbreaks, public health emergencies), vendors will be eligible for a refund.

Other than the circumstances outlined above, no refunds will be issued once the event has commenced. 

  1. Wet-weather Plan
The market is a rain or shine event; no refunds will be issued for inclement weather. However, if rain persists for more than 2 hours during the event:
    • Vendors may be eligible for a discount on their booth fees for future events.
    • Eligible vendors will be notified after the event concludes.
    1. Vendor Public Liability Policy

    The Organiser is not liable for any injuries, theft, or damage to vendors' property during the event.

    Vendors are responsible for their own safety and the safety of their products and equipment within their designated booth zone, which is clearly marked at the event. Vendors will be held liable for any incidents or damages that occur within their booth zone.

    The Organizer's insurance does not cover vendor activities or property; therefore, vendors should not rely on the Organizer's insurance for their protection. Vendors must obtain their own public liability insurance to cover any potential claims or losses

    1. Force Majeure
    The organiser is not liable for any cancellation or disruption of the event due to circumstances beyond our control, such as extreme weather, government restrictions, or natural disasters.
    1. Dispute Resolution

    Any disputes arising from participation in the market, including any questions regarding the existence, validity, or termination of this Agreement, will be addressed through mediation or arbitration before any legal action is considered. Specifically, disputes shall be referred to and finally resolved by arbitration administered by the Singapore Mediation Centre (SMC) in accordance with the Mediation Rules of the SMC. The seat of mediation shall be Singapore, and the Tribunal shall consist of one (1) mediator. The language of the arbitration shall be English.

    1. Amendments

    The organiser reserves the right to amend these terms and conditions at any time and without prior notice.
